DEBT RECOVERY (UP TO £100,000)

 

Our debt recovery matters dealt with on a bespoke basis much like all our other practice areas, as no debt collection claim is the same. As such, it can be difficult to provide a reliable estimate of the cost until we have full details. These costs are applicable only in the circumstance wherein your claim is in relation to an unpaid invoice which is not disputed and where enforcement action is not needed.

 

If, however, the other party disputes your claim at any point, we will discuss any further work that may be required and we will provide you with revised advice about costs, if necessary, which could be on a fixed fee (e.g. if a one-off letter is required), or an hourly rate if more extensive work is needed.

If you wish to proceed, please be aware that:

 

  • For claims less than £10,000, our fees are not usually reclaimed from your debtor;

 

  • Interest and compensation may take the debt into a higher banding, with a higher cost;

 

  • The costs quoted above are not for matters where enforcement action, such as the bailiff, is needed to collect your debt;

 

  • The fee does not include disbursements, which must be paid in addition. Typical disbursements include but are not limited to Court fee, process server (where necessary), photocopying, and postage.

 

Our fee includes:

 

  • Taking your instructions and reviewing documentation;

 

  • Undertaking appropriate searches;

 

  • Sending a letter before action;

 

  • Receiving payment and sending onto you, or if the debt is not paid, drafting and issuing claim;

 

  • Where no Acknowledgment of Service or Defence is received, applying to the court to enter Judgment in default;

 

  • When Judgment in default is granted, writing to the other side to request payment;

 

  • If payment is not received within 14 days, providing you with advice on next steps and likely costs.

 

Duration

Where the matter is not disputed, it usually takes between 2 and 12 weeks from receipt of instructions from you to receipt of payment from the other side. Where the matter is disputed and a claim needs to be made, various factors determine how long the matter takes to be concluded including but not limited to how long the Court takes to process the paperwork at any stage and in this instance, it could take months to resolve. This is on the basis that the other side pays promptly on receipt of Judgment in default. If enforcement action is needed, the matter will take longer to resolve.

The above fees are Albright Kendrick’s fees and they exclude any disbursements that may be applicable to your case such as Counsel’s fee, Expert’s, and Court fees.
